利用規約

本規約は、占い／オラクルサービス「Clockwork Oracle」（以下「本サービス」）の利用条件を定めるものです。利用者は、本規約に同意のうえ本サービスをご利用ください。

第1条（適用）

本規約は、運営者（販売業者：SHIJIMI KEN ／運営責任者：Matsuoka Miyoko。以下「運営者」）が提供する本サービスの利用に関し、運営者と利用者との間に適用されます。利用者は、本サービスを利用した時点で本規約に同意したものとみなされます。

第2条（本サービスの内容）

本サービスは、2枚のカードによる占い・オラクルメッセージを提供する娯楽コンテンツです。次の2つの利用形態があります。

無料利用：登録不要。1日1回までご利用いただけます。
有料会員：月額248円（消費税込）で、占い回数が無制限になります。

第3条（利用料金および有料会員）

有料会員の料金は月額248円（消費税込）です。
お支払いは、決済代行サービス Stripe を通じたクレジットカード決済によります。
有料会員は、決済の完了をもって即時に有効となります。

第4条（自動更新および解約）

有料会員は1か月ごとの自動更新です。解約のお手続きをいただかない限り、各更新日に自動的に更新・決済されます。
解約はいつでも可能です。解約用リンク（Stripeカスタマーポータル）からお手続きください。
解約後は、その時点の契約期間（次回更新日）の終わりまで会員機能をご利用いただけ、以降の自動更新は停止します。

第5条（返金）

本サービスはデジタルコンテンツの性質上、決済後のキャンセル・返金は原則としてお受けできません（日割りでの返金もございません）。ただし、運営者の責に帰すべき事由による場合はこの限りではありません。

第6条（無料利用の制限）

無料利用は1日1回までです。この回数の判定は利用者のブラウザ内の記録に基づいて行われるため、ブラウザや端末を変えた場合など、判定が前後することがあります。回数制限を不正に回避する行為はお控えください。

第7条（禁止事項）

利用者は、本サービスの利用にあたり、次の行為を行ってはなりません。

法令または公序良俗に反する行為
運営者または第三者の著作権その他の権利を侵害する行為
本サービスのコンテンツ（カード画像・イラスト・診断文・テキスト・BGM等）を、私的利用の範囲を超えて複製・改変・転載・配布・販売・商用利用する行為
不正アクセス、リバースエンジニアリング、システムへの過度な負荷をかける行為、自動化ツール等による不正な利用
決済手段の不正利用、なりすまし、その他不正な目的での利用
その他、運営者が不適切と判断する行為

第8条（知的財産権・著作権）

本サービスに含まれるカード画像・イラスト・診断文・テキスト・BGM・ロゴ・デザインその他一切のコンテンツに関する著作権およびその他の知的財産権は、運営者または正当な権利者に帰属します。
利用者は、これらのコンテンツを、私的利用の範囲を超えて複製・改変・転載・配布・商用利用することはできません。
占い結果のスクリーンショット等を、個人的にSNS等で共有することは差し支えありません。ただし、画像・文章の改変や、コンテンツを抜き出しての再配布・商用利用は禁止します。

第9条（免責事項）

本サービスの占い結果・診断文・メッセージは、娯楽を目的として提供されるものであり、その的中・効果・有用性を保証するものではありません。
本サービスの内容は、医療・法律・金融・投資・健康・進路その他の専門的な助言に代わるものではありません。重要な判断にあたっては、必ず各分野の専門家にご相談ください。
利用者が本サービスの結果に基づいて行った判断・行動について、運営者は責任を負いません。
運営者は、本サービスの提供の中断・停止・終了、データの消失、通信環境や利用者の端末に起因する不具合等によって利用者に生じた損害について、運営者の故意または重過失による場合を除き、責任を負いません。
なお、消費者契約法その他の法令により運営者が損害賠償責任を負う場合であっても、その賠償の範囲は、当該損害が発生した時点から遡って直近1か月間に利用者が運営者へ支払った利用料金の額を上限とします（運営者の故意または重過失による場合を除く）。

第10条（サービスの変更・中断・終了）

運営者は、利用者への事前の通知なく、本サービスの内容を変更し、または本サービスの提供を中断・終了することができます。これによって利用者に生じた損害について、運営者の故意または重過失による場合を除き、責任を負いません。

第11条（個人開発による運営について）

本サービスは個人開発によって運営されています。診断内容や翻訳は品質向上に努めていますが、AIを利用しているため、表現が不自然になったり、一部の言語で誤訳や表示上の不具合が発生する場合があります。また、サービス内の不具合やご要望については順次対応いたしますが、個人で運営しているため、修正・機能追加・お問い合わせへの対応にお時間をいただく場合があります。あらかじめご了承ください。

第12条（規約の変更）

運営者は必要に応じて本規約を変更することがあります。変更後の規約は本ページに掲載した時点で効力を持つものとします。

第13条（準拠法および管轄裁判所）

本規約は日本法を準拠法とし、本サービスに関して紛争が生じた場合は、大阪地方裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Service

These Terms of Service set forth the conditions for using the fortune-telling/oracle service "Clockwork Oracle" (hereinafter referred to as the "Service"). Users shall agree to these terms before using the Service.

Article 1 (Application)

These terms apply between the operator (Seller: SHIJIMI KEN / Operations Manager: Matsuoka Miyoko; hereinafter referred to as the "Operator") and the user regarding the use of the Service. By using the Service, the user is deemed to have agreed to these terms.

Article 2 (Service Description)

The Service is entertainment content that provides fortune-telling and oracle messages using two cards. There are two types of usage:

Free Use: No registration required. Limited to once per day.
Paid Membership: 248 JPY per month (tax included) for unlimited access.

Article 3 (Fees and Paid Membership)

The fee for Paid Membership is 248 JPY per month (tax included).
Payments are processed via credit card through the payment service provider Stripe.
Paid Membership becomes effective immediately upon completion of the payment.

Article 4 (Automatic Renewal and Cancellation)

Paid Membership is automatically renewed every month. Unless cancelled, the subscription will automatically renew and be billed on each renewal date.
Cancellation can be made at any time via the cancellation link (Stripe Customer Portal).
After cancellation, you can continue to use the member functions until the end of the current billing period (the next renewal date), after which automatic renewal will stop.

Article 5 (Refunds)

Due to the nature of digital content, cancellations or refunds after payment are generally not accepted (no pro-rated refunds). However, this shall not apply in cases attributable to the Operator's liability.

Article 6 (Limitations on Free Use)

Free use is limited to once per day. This limit is determined based on records within the user's browser; therefore, the count may vary if the browser or device is changed. Please refrain from acts that unfairly bypass the frequency limit.

Article 7 (Prohibited Acts)

Users shall not engage in the following acts:

Acts that violate laws or public order and morals.
Acts that infringe upon the copyrights or other rights of the Operator or third parties.
Reproducing, modifying, reprinting, distributing, selling, or commercially using the Service's content (card images, illustrations, readings, text, background music, etc.) beyond the scope of personal use.
Unauthorized access, reverse engineering, imposing excessive load on the system, or unauthorized use through automated tools.
Fraudulent use of payment methods, impersonation, or use for other illicit purposes.
Other acts deemed inappropriate by the Operator.

Article 8 (Intellectual Property Rights)

All copyrights and other intellectual property rights regarding the card images, illustrations, readings, text, background music, logos, and designs included in the Service belong to the Operator or the respective right holders.
Users may not reproduce, modify, reprint, distribute, or commercially use these contents beyond the scope of personal use.
Sharing screenshots of fortune-telling results on social media for personal use is permitted. However, modifying images/text or extracting content for redistribution or commercial use is prohibited.

Article 9 (Disclaimers)

The fortune-telling results and messages of the Service are provided for entertainment purposes only and do not guarantee accuracy, effectiveness, or utility.
The content of the Service is not a substitute for professional advice in medical, legal, financial, investment, health, career, or other fields. For important decisions, always consult a specialist in the respective field.
The Operator shall not be held responsible for any decisions or actions taken by the user based on the results of the Service.
The Operator shall not be liable for any damages caused by interruptions, suspension, termination of the Service, loss of data, or malfunctions caused by the communication environment or the user's device, except in cases of intentional or gross negligence by the Operator.
Even if the Operator is held liable for damages under the Consumer Contract Act or other laws, the scope of compensation shall be limited to the amount of the usage fee paid by the user to the Operator in the one month immediately preceding the occurrence of the damage (except in cases of intentional or gross negligence).

Article 10 (Changes to or Termination of Service)

The Operator may change the content of the Service or suspend/terminate the provision of the Service without prior notice. The Operator shall not be held liable for any damages resulting from such changes or termination, except in cases of intentional or gross negligence.

Article 11 (Note on Personal Development)

This Service is operated as a personal development project. While we strive to improve quality, the use of AI may result in unnatural expressions, mistranslations, or display issues in some languages. Responses to bugs or feature requests will be handled sequentially, but please understand that as a personal operation, it may take time to address inquiries or implement fixes.

Article 12 (Modification of Terms)

The Operator may modify these terms at any time as necessary. Modified terms shall become effective upon being posted on this page.

Article 13 (Governing Law and Jurisdiction)

These terms shall be governed by Japanese law. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Osaka District Court as the court of first instance.
